A new home on James Island is permitted by the Town of James Island, the City of Charleston or Charleston County, depending on the parcel — and every address on the island shares the 29412 ZIP code, so the mailing address tells you nothing about which rules apply. Zoning, setbacks, tree protection and the permit office all change at the jurisdiction line. Three Jurisdictions, One ZIP Code

Large parts of James Island sit inside the incorporated Town of James Island. Other areas have been annexed by the City of Charleston, and pockets remain in unincorporated Charleston County. The boundaries run parcel by parcel, sometimes house by house on the same street.

Before you make an offer, look the parcel up on the Charleston County parcel viewer and confirm its jurisdiction and zoning district. We do this on every lot review, because the answer decides the setbacks, the height limit, the tree rules and the permit timeline.

Permits Moved in 2026

As of May 1, 2026, the Town of James Island issues its own building permits and runs its own inspections through SAFEbuilt, using a Community Core online account. Projects that were already underway continue with Charleston County Building Services.

Parcels in the City of Charleston are permitted by the City, and unincorporated parcels by the County. If an older checklist or a previous builder tells you James Island permits all run through the County, it is out of date for Town parcels.

Grand Trees

James Island’s live oaks are protected, and the threshold depends on the jurisdiction. The Town of James Island treats any tree 18 inches or larger in diameter at breast height as a grand tree, except pine and sweet gum. Removal needs a permit, and a healthy grand tree generally needs a variance from the Board of Zoning Appeals. The City of Charleston and Charleston County draw their grand-tree line at 24 inches.

In practice the trees often decide where the house goes. We order the tree survey before design, not after, and lay out the footprint, driveway and utilities around the root zones.

Marsh, Water and Flood Zones

James Island is ringed by James Island Creek, the Folly River, the Stono River and Charleston Harbor. Waterfront and marsh-front lots usually sit in AE flood zones, which set the finished-floor elevation, and marsh-front parcels carry the OCRM critical line and its buffer. Higher interior ground is often in zone X, with very different foundation costs.

The flood zone is a parcel-level fact, not a neighborhood one. We read the FIRM panel and, where available, an elevation certificate before pricing any James Island build.

Sewer, Septic and Utilities

Some James Island lots are on public sewer; others, especially older and larger parcels, are on septic. A septic lot needs a soils evaluation and a permit from the state environmental agency, and the drain field takes buildable area that a sewer lot does not lose.

Water, sewer availability and tap fees vary by provider and location. We confirm them during due diligence so the site-work budget is real before construction pricing begins.

Teardowns and Infill

Much of the new construction on James Island replaces mid-century ranch houses on generous lots in established neighborhoods such as Riverland Terrace. The question is usually renovate or replace.

If a renovation’s cost reaches half the existing structure’s market value in a flood zone, federal floodplain rules treat it as a substantial improvement and the whole house must be brought into flood compliance — which often makes a new elevated home the better investment. We price both paths before you decide.
